Terms & Conditions -

1. Scope of Work and Estimates

  • Detailed Scope: Services are strictly limited to the written line items in your approved estimate. Add-on requests like "while you are here" tasks require a separate written agreement.

  • Estimate Expiration: All project pricing is valid for exactly fifteen (15) days from the issued date.

  • Material Substitutions: If specific plants or hardscape materials are unavailable, the Company reserves the right to substitute comparable materials.

2. Payment Terms and Late Fees

  • Deposits: Landscape installation projects require a 50% upfront deposit before work begins. The remaining balance is due immediately upon completion.

  • Recurring Services: Maintenance accounts are billed monthly and due within fifteen (15) days of the invoice date.

  • Late Payments: Unpaid balances accrue a 1.5% monthly finance charge until paid in full. The Company will pause all services on accounts overdue by more than thirty (30) days.

3. Property Access and Site Readiness

  • Unobstructed Access: The Client must unlock gates and provide clear access to all service areas on scheduled dates.

  • Debris Removal: Lawns must be clear of pet waste, toys, and lawn furniture. The Company is not liable for damage to items left in the workspace.

  • Property Lines: The Client assumes full responsibility for accurately identifying property boundaries.

4. Underground Utilities and Structural Disclosures

  • Utility Marking: The Client must flag private underground items like dog fences, landscape lighting, or invisible drainage tiles. The Company is not liable for damage to unmarketed private lines.

  • Heavy Machinery: Landscaping involves heavy equipment. The Company takes precautions but is not responsible for minor cracking or settling of driveways, sidewalks, or patios.

5. Client Watering Responsibilities

  • Plant Survivability: The Client is strictly responsible for watering all new turf, sod, shrubs, and trees according to provided care instructions.

  • Exclusions: The Company will not replace or warrant any plant material that dies due to under-watering, over-watering, or Client neglect.

6. Warranties and Limitations of Liability

  • Plant Warranty: Newly installed trees and shrubs carry a thirty (30) day warranty from the installation date, provided proper watering occurs. Sod, annuals, and perennials carry no warranty.

  • Flying Debris: The Company utilizes commercial mowers and trimmers. We are not liable for accidental window or glass breakage caused by rocks or debris hidden in the grass.

  • Acts of God: The Company is not responsible for plant death or project delays caused by extreme weather, pests, drought, or floods.

7. Cancellations and Termination

  • Maintenance Agreements: Routine lawn care agreements may be canceled by either party with a written thirty (30) day notice.

  • Project Cancellations: If a client cancels a custom hardscape or design project after signing, the initial deposit is non-refundable to cover materials already ordered.
